Privacy Policy and the Attorney-Client Relationship: Allen Legal does not collect or store the personal information of any users who are or were not the clients of the firm. An attorney-client relationship is only formed between the User and Allen Legal by the express written agreement of both parties. Neither contacting, nor receiving back a reply from Allen Legal, creates any attorney-client relationship. Allen Legal maintains a client file on all Users who successfully contact us for legal advice ("advice clients") or who otherwise become clients of the firm. Client files may contain the private and confidential personal identifying information of the client, including first and last name, job title, business name and location, mailing address, telephone number, email address, and the basic information you supply to us about any legal matter you consult with us about. This information will be protected and secured in good faith and under commercially-reasonable standards and State Bar rules. We never sell, offer to sell, share, lease or otherwise distribute or transmit your data, except as allowed by law and expressly authorized by you. We are not a lead-generator, data broker or data seller. We do not collect biometric information, precise geolocation data, racial/religious/sexual/political information, health information, financial account logins and the like, the data of minors, or any other sensitive data. The "Contact Us" features of our Websites deliver user messages to Allen Legal via email, which is not guaranteed to be a secure means of communication. Additionally, information exchanged through the "Contact Us" feature may or may not be protected by the attorney-client privilege or the attorney work product doctrine. Admission to Practice: Except where specifically noted otherwise, our attorneys are licensed in Utah only, but are regularly admitted in other states pro hac vice on a per-case basis, to defend TCPA and similar cases. Any advice provided to persons outside the state of where one of our lawyers is licensed, constitutes either non-legal advice, mere legal information, or permissible legal advice that falls under the multi-jurisdictional practice exceptions. These exceptions include, without limitation, the right of a licensed attorney to provide limited advice to persons out of state when the attorney properly associates with local counsel, when such advice is reasonably related to the lawyer's regular in-state practice, or when the advice relates to the lawyer's expertise in a particular aspect of national/federal law (such as the TCPA and other federal telemarketing laws, for example). However, all such rules vary from state to state and Allen Legal may not be able to provide advice or representation to you in certain circumstances because of the nature of the advice sought or the local rules in your state. ALL OFFERS ON OUR WEBSITES ARE VOID WHERE PROHIBITED BY LAW. Choice of Law and Venue: Any dispute arising out of this Agreement, User's use of our Websites, or information obtained from our Websites, shall be brought and heard by User only in the courts of the State of Utah, and only after the parties have engaged in a confidential, good-faith, private mediation in Salt Lake City, Utah, solely at User's expense and lasting at least four hours. This Agreement shall be construed according to the law of the state of Utah without giving effect to normal choice of law and conflict of laws rules.
User's Sole Remedy: Notwithstanding anything to the contrary contained herein, you agree that your sole remedy for Allen Legal's violation of this Agreement, or for any other claim or action arising from this Agreement or your use of our Websites or services, shall be your right to terminate your use of our Websites and services. This is a significant restriction on your possible remedies and if you do not agree to these terms, please do not make any use of our Websites. You are waiving your right to sue us or have a jury trial.
Information Provided on our Websites: The information provide on our Websites is informational only and is not legal advice or attorney advertising.
